GENERAL TERMS & CONDITIONS
The Swapi Platform is owned and operated by Swapi Limited, a company registered in England with company number 12783657 and registered office at 124 City Rd, London EC1V 2NX.

2. If you have any questions or complaints about this service, please contact us. You can write to at firstname.lastname@example.org or you can contact us via Contact Us page on the Swapi website.
2.1. To register to use the Swapi Platform, download the Swapi App. Add your full name (as stated on your passport), date of birth, preferred mailing address, email address and telephone number for correspondence.
2.2. If there are any changes to the information you provided, you are responsible for updating the information. If you don’t you may not receive information regarding your Swapi Wallet, the Swapi Platform or changes that we may make to the Agreement from time to time. You can update your information any time via the Swapi App.
2.3. As a condition of your use of this Swapi Platform, you confirm (i) you are at least 18 years of age; (ii) you possess the legal capacity to enter into this Agreement; (iii) you will use this Swapi Platform in accordance with this Agreement; and (iii) all information supplied to us by you is true, accurate, current and complete. We retain the right at our sole discretion to deny access to your Swapi Wallet, the Swapi Platform and the services we offer at any time and for any reason, including, but not limited to, or violation of this Agreement.
2.4. You may register for one Swapi Wallet only. In case of duplication of a registration, all registrations (other than the first registration approved by us) will be cancelled. Any duplicate points in other Swapi Wallets will be cancelled.
2.5. Once registration is complete, you will be provided access to Swapi and can add loyalty cards to your wallet.
2.6. Your use of your Swapi Wallet and the Swapi Platform is for personal purposes only. Registration as a Swapi User is not open to companies, partnerships, unincorporated associations, sole traders or other entities or individuals using the Swapi Platform for commercial purposes.
2.7. Registration as a Swapi User is offered at our discretion and we may refuse such registration of an individual.
3. Swapi points
3.1. You can collect Swapi points in different ways including via our card linking partners, affiliate partners and via promotional and bonus point periods.
3.2. Swapi points have no cash value and cannot be redeemed or exchanged for cash.
3.3. Swapi points have no expiry.
4. Swapi Wallet
4.1. You can view your Swapi Wallet in the Swapi App at any time.
4.2. Your Swapi Wallet shows your swaps and points balance. If you’ve added a third-party provider, you’ll see your points balance with that provider as well as your Swapi points.
4.3. Points or rewards provided by third party providers are subject to the terms and conditions of that provider, which you should check.
5. How you can swap
5.1. Swap your points
Through the Swapi Platform you can swap points registered in your Swapi Wallet for other points-based programmes, products, rewards, offers or other promotions available on the Swapi Platform (each a “Promotion”). Each Promotion is subject to separate terms and conditions of the provider of it, so before you swap your points, make sure you have read and agree to such terms and conditions. These will apply to you when you make the swap.
5.2. When swapping your points for a Promotion in the Swapi Platform, we will deduct the relevant points from your Swapi Wallet instantly.
5.3. In relation to a Promotion that provides you with points, those points will be added to your Swapi Wallet after we receive confirmation from the relevant provider. This is usually within 3 business days.
5.4. Collect Swapi points when you link your debit or credit card
If you have a debit or credit card and the card scheme has partnered with Swapi, you can link your card to your Swapi Wallet. Every time you purchase goods / services (in-store or online) using your linked card you will earn Swapi points You can check in the swapi App if your card issuer is a Swapi partner. The list of card schemes who have partnered with us is updated regularly, so check the Swapi App for updates to this list. The terms on which Swapi points are earned, the qualifying transactions and number of Swapi points earned are set by the card scheme. Make sure you have read and agree to such terms beforehand as these will apply to this feature. Like your loyalty points, you can swap Swapi points collected for a Promotion.
5.5. Swap expired points for Swapi points
If you have points earned from a third-party provider that have expired, you may be able to swap them for Swapi points. Check our list of points schemes that we will swap for Swapi points. You will need to provide us with a photograph or file as proof of your expired points balance which includes the total number of expired points. Expired points can only be swapped once. We will advise you how many Swapi points you will receive once we receive your proof of expired points. We reserve the right to place a maximum cap on the number of Swapi points you are awarded for your expired points. The list of points schemes that we will exchange expired points from are updated regularly, so check the Swapi App for updates to this list.
5.6. Only points showing in your Swapi Wallet can be used for a Promotion.
5.7. Any points you use for a Promotion will be deducted from your Swapi Wallet. If you used points from a third-party provider, the deduction is displayed under the relevant third party provider listed in your Swapi Wallet.
5.8. Similarly, any points you receive in relation to a Promotion will be added to the relevant loyalty programme, you’ll see the addition in your Swapi Wallet.
5.9. Promotions: All Promotions are subject to availability and subject to the terms and conditions of the provider of such Promotion, these are displayed with the relevant Promotion. Please check them before you make a swap.
5.10. We have no responsibility for the delivery, standard, quality or otherwise of any goods and services received or supplied to you in respect of a Promotion. If you experience a problem in relation to a Promotion, you should contact the provider.
5.11. If following contact with the Provider, the issue remains unresolved you can contact us. We may be able to provide further information to you to assist you.
5.12. If for any reason a Promotion is cancelled or not completed for any reason, any points used in relation to it will be returned to you. Points will only be added when we receive instruction from the provider of such Promotion.
5.13. If you believe there is an error in the points showing in your Swapi Wallet, please contact us. We may require you to provide further information regarding the error. We will correct your Swapi Wallet if it is shown to our reasonable satisfaction an error has occurred. Our decision on each error raised will be final.
5.14. Your Swapi Wallet is personal to you and cannot be transferred to anyone else.
5.15. Points can only be earned, held, transferred or redeemed as set out in these Terms. Any points not earned, held, transferred or redeemed in accordance with these Terms will be invalid and cannot be redeemed for any Promotion. In such event, such points will be deducted from your Swapi Wallet. In the event they have been used in a swap, we will ask the Promotion provider to cancel the relevant Promotion. We also reserve the right to take any other action as we deem appropriate in the circumstance.
6. Our right to close your Swapi Wallet and/or end this Agreement
6.1. We may close your Swapi Wallet and end this Agreement if your Swapi Wallet contains no Swapi points and no swaps have been made using Swapi points or any other points relating to a third-party provider that’s been linked to your Swapi Wallet, for a continuous period of at least 12 months.
6.2. We may also, on notification to you immediately suspend or terminate your access to the Swapi Platform and/or close your Swapi Wallet, if (i) you breach these Terms, (ii) if we reasonably believe or have been made aware that your use of the Swapi Platform, collection of points or swaps is carried out in a manner not permitted by these Terms or any applicable third party provider’s terms and conditions, (iii) if there is any misconduct in connection with us, any third party provider of points or rewards or Promotion, (iv) if you supply false or misleading information to us or (iii) if you are abusive or offensive to any member of our staff or post any abusive or offensive communications about us or the Swapi Platform.
6.3. We may suspend or stop issuing or accepting Swapi Points, operating the Swapi Platform or any of the services related to it at any time. If we do will give as much notice as we reasonably can before we do so. If this happens all Swapi points will be suspended or terminated.
7. Your right to close your Swapi Wallet and / or end this Agreement
7.1 You can close your Swapi Wallet at any time by notifying us. Once your Swapi Wallet is closed, your right to use Swapi points in it cease. You will still be able to use points you have earned with a third-party provider in accordance with the third-party providers terms and conditions of use.
8.1. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes our liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors, or for fraud or fraudulent misrepresentation.
8.2. Our sole liability to you will be to credit any points to you which have been wrongly deducted or should have been credited but were not.
8.3. All information and/or data included in and/or on the Swapi Platform is made available for guidance only. We do not make any representations, warranties or terms of any kind in respect of the Swapi Platform or its content (including, without limitation, any views or comments made) other than those required by law. We expressly exclude, to the fullest extent permitted by law, all liability of Swapi Limited, its directors, employees or other representatives, howsoever arising, for any loss suffered as a result of your use of the Swapi Platform.
8.4. The Swapi Platform may include links to websites and/or services provided by participating businesses. These are provided for your convenience and we are not responsible for and do not give any warranties or make any representations regarding any such websites and/or services and are not responsible for or liable in relation to the content or your use of such websites (other than to the extent required by law).
8.5. Our service is provided through the Swapi App and swaps are made online via the Swapi Platform. Due to the nature of the Internet and functionality of the App, we do not promise full and error free operation of the Swapi App and Swapi Platform at all times.
9. How we may use your personal information.
9.2.1. The personal information we collect about you when you register as a Swapi User and you use our service;
9.2.2. How we will use your personal information in the course of providing our service to you, when we inform you about updates on your account, new features, any changes we make to our service and with whom we will share your personal information; and
9.2.3. How we and third parties with whom we share your personal information, will use it when we carry out marketing and promotional activities online, through the swapi App, by text (SMS), post and email.
10. Intellectual Property Rights in and to the Swapi Platform
10.1. The intellectual property in all design, text, graphics and other material on the Swapi Platform is owned by us and/or our respective licensors.
10.2. The Swapi Platform is made available for use in connection with you participating in the swaps available through it for your personal use. You may as part of your use copy and print portions of the content on the Swapi Platform but you should not access, copy, republish, share or use such content to generate income of any kind or for any other purpose without our prior written permission.
11. Other important terms
11.1. If there is any conflict or inconsistency with any other communications we publish in relation to the Swapi Platform, such as advertising or promotional materials relating to your use of the Swapi Platform then the terms in this Agreement shall prevail.
11.2. If we sell or transfer the Swapi Platform to another company we may transfer all of our rights and obligations under these Terms to you without any further consent and may disclose or transfer all information we hold about you to a prospective or actual new owner. Such a disclosure or transfer will not alter your rights under these Terms.
11.4. These Terms are personal to you and you cannot transfer your rights or your obligations under these Terms. However, we may transfer our rights and obligations under these Terms to another organisation.
11.5. These Terms are between you and us. No other person shall have any rights to enforce any of its terms.
11.6. Each of the clauses of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
11.7. If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of your breaking this agreement, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
11.8. These terms are governed by English law and you can bring legal proceedings in the English courts. If you live in Scotland or Northern Ireland you can bring legal proceedings in Scotland or Northern Ireland (as applicable to you) or the English courts.
